Point Alpha Terms of Service
Last updated: 22 August 2026
Welcome to Point Alpha.
These Terms of Service govern your use of the Point Alpha website and your purchase of products from us. By accessing our website or placing an order, you agree to these terms.
1. About Point Alpha
Point Alpha is an online clothing and lifestyle brand selling products through our website.
Throughout these Terms, “Point Alpha”, “we”, “us” and “our” refer to Point Alpha.
“You” and “your” refer to the person using our website or purchasing our products.
2. Using Our Website
You agree to use our website lawfully and responsibly.
You must not:
- Use our website for any unlawful or fraudulent purpose.
- Attempt to gain unauthorised access to our website or systems.
- Interfere with the operation or security of the website.
- Copy, reproduce or misuse our branding, images, designs or other content without permission.
- Use our website to distribute harmful, misleading or malicious material.
We reserve the right to suspend or restrict access to our website where we reasonably believe these terms have been breached.
3. Products
We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on your device or screen settings.
Product availability is subject to change without notice.
We reserve the right to limit the quantity of products that may be purchased by an individual customer where reasonably necessary.
4. Product Sizes and Fit
Customers are responsible for selecting the appropriate size before placing an order.
We provide size information and measurements where available to help customers choose the correct size.
If you order the wrong size, you may return the item in accordance with our Refund & Returns Policy. Return postage for change-of-mind or sizing returns is the customer’s responsibility.
5. Prices
All prices displayed on our website are shown in pounds sterling (£), unless otherwise stated.
We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted and confirmed.
We make reasonable efforts to ensure that prices displayed on our website are correct.
If we discover a genuine pricing error before an order has been accepted, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order.
6. Orders
When you place an order, you are making an offer to purchase the products selected.
After placing your order, you should receive an order confirmation.
An order confirmation does not necessarily mean that your order has been accepted. We reserve the right to decline or cancel an order in appropriate circumstances, including where:
- A product is unavailable.
- There is an obvious pricing or product description error.
- We suspect fraudulent or unlawful activity.
- We are unable to fulfil the order.
- The order has been placed in breach of these Terms.
If we cancel an order after payment has been taken, you will receive a refund of the amount paid for the cancelled order.
7. Payment
Payment must be made using one of the payment methods available at checkout.
Payment must be successfully authorised before an order can be processed.
We do not store complete payment card details ourselves where payment is processed through a third-party payment provider.
8. Shipping and Delivery
We will aim to dispatch orders within the timeframe stated on our website.
Delivery times are estimates and may vary depending on the delivery service, destination, weekends, public holidays or circumstances outside our reasonable control.
Once an order has been dispatched, delivery is carried out by the relevant delivery provider.
If your order does not arrive within the expected timeframe, please contact us so that we can investigate.
Nothing in these Terms limits your statutory rights regarding delivery.
9. Returns and Refunds
Our Refund & Returns Policy forms part of these Terms.
For change-of-mind returns, the customer is responsible for the direct cost of returning the product to Point Alpha.
Returned clothing should be unwashed, unworn except for reasonable inspection or fitting, undamaged and in the condition in which it was received.
Where permitted by law, we may make an appropriate deduction from a refund where an item has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning and this has reduced its value.
Faulty, damaged, incorrectly supplied or misdescribed products remain subject to your statutory consumer rights.
Please refer to our Refund & Returns Policy for full details.
10. Cancellation Rights
Where applicable, customers purchasing online have statutory cancellation rights under UK consumer law.
Nothing in these Terms removes or restricts any statutory rights that you have.
Where a customer exercises a statutory cancellation right, the applicable rules regarding refunds, delivery charges and return postage will apply.
11. Faulty or Incorrect Products
If you receive a product that is faulty, damaged, defective, incorrectly supplied or not as described, please contact us.
We will deal with the issue in accordance with your statutory consumer rights.
You should contact us before returning a faulty or incorrectly supplied item so that we can provide appropriate instructions.
12. Intellectual Property
All Point Alpha branding, logos, graphics, photographs, product designs, text, website content and other original materials are owned by or licensed to Point Alpha unless otherwise stated.
You must not reproduce, copy, modify, distribute, sell or commercially exploit our intellectual property without our prior written permission.
This includes copying Point Alpha logos, clothing designs, photographs or marketing materials for use by another business.
13. User Content
If you submit photographs, reviews, comments or other content to Point Alpha, you are responsible for ensuring that you have the right to provide that content.
You must not submit content that is unlawful, defamatory, abusive, threatening, discriminatory, misleading or infringes another person’s intellectual property or privacy rights.
Where you provide content for use by Point Alpha, you grant us permission to use it for legitimate business and marketing purposes where you have agreed to such use.
We reserve the right to remove content that breaches these Terms.
14. Website Availability
We aim to keep our website available and functioning correctly.
However, we do not guarantee that the website will always be available, uninterrupted or completely free from errors.
We may temporarily suspend the website for maintenance, updates, security reasons or other operational purposes.
15. Third-Party Services
Our website may use third-party services, including payment providers, delivery companies, Shopify and other technology providers.
These third parties may have their own terms and privacy policies.
We are not responsible for the operation of third-party websites or services outside our reasonable control.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
This includes liability that cannot legally be excluded or limited under UK consumer protection law.
Subject to this, Point Alpha will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms affects your statutory consumer rights.
17. Events Outside Our Control
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control.
These may include, for example:
- Natural disasters.
- Severe weather.
- Strikes or industrial action.
- Transport disruption.
- Government restrictions.
- Internet or telecommunications failures.
- Problems affecting third-party delivery services.
- Supplier or manufacturing disruption.
- Other events that could not reasonably have been prevented.
Where reasonably possible, we will keep customers informed of significant delays.
18. Fraud and Suspicious Orders
We reserve the right to investigate orders that we reasonably believe may involve fraud, payment abuse or other unlawful activity.
Where necessary, we may cancel or refuse an order and refund any payment that has already been taken.
We may also retain information where required for fraud prevention, legal compliance or other legitimate business purposes.
19. Privacy
Your personal information is handled in accordance with our Privacy Policy.
By using our website and placing an order, you acknowledge that your information will be processed as necessary to fulfil your order, provide customer support, process payments and operate our business.
20. Changes to These Terms
We may update these Terms from time to time.
The latest version will be published on our website.
Changes will not affect rights relating to orders that have already been placed where doing so would be unlawful.
21. Governing Law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you will also benefit from any mandatory protections provided by the laws applicable to you.
Nothing in these Terms prevents you from exercising your statutory consumer rights.
